Welcome to SpeakOut. By downloading, installing, or using the SpeakOut mobile application ("Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using SpeakOut, you confirm that you are at least 13 years old and agree to comply with these Terms. If you do not agree with any part of these Terms, you may not use the Service.

2. Description of Service

SpeakOut is an AI-powered emotional wellness application that provides:

• Real-time voice-based conversation with an AI companion
• Emotional analysis and insights
• Mood tracking and emotional pattern visualization
• Emotion transformation suggestions

Important: SpeakOut is not a substitute for professional mental health care. It is a wellness tool designed to help you reflect on and process everyday emotions. If you are experiencing a mental health crisis, please contact a licensed professional or emergency services.

3. User Accounts

• You may sign in using Google Sign-In, Apple Sign-In, or Anonymous authentication.
• You are responsible for maintaining the security of your account.
• You must not share your account credentials or allow others to access your account.
• You may delete your account at any time through the app Settings or via our account deletion page.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, hack, or disrupt the Service
• Transmit harmful, threatening, or abusive content
• Use the Service to harass, abuse, or harm others
• Create multiple accounts to abuse free tier limitations
• Use automated systems or bots to access the Service

5. Subscriptions and Payments

5.1 Free Tier

SpeakOut offers a free tier with limited features, including shorter session durations and basic emotional analysis.

5.2 Pro Subscription

• SpeakOut Pro is available as a monthly or yearly auto-renewable subscription.
• Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription through your device's App Store or Google Play settings.

5.3 Refunds

Refund requests are handled by Apple App Store or Google Play Store according to their respective refund policies. We do not process refunds directly.

6. Intellectual Property

All content, design, branding, and technology within SpeakOut are owned by InnoFun Digital Entertainment LLC and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without explicit permission.

7. User Content

• You retain ownership of all content you create through the Service (session transcripts, insights, etc.).
• By using the Service, you grant us a limited license to process your content for the purpose of providing the Service.
• We do not claim ownership of your emotional data or session content.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• The Service will be uninterrupted or error-free
• AI-generated insights will be perfectly accurate
• The Service will meet all your specific requirements

9. Limitation of Liability

To the fullest extent permitted by law, InnoFun Digital Entertainment LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

10. Crisis Situations

SpeakOut includes crisis detection features. If our AI detects content indicating potential self-harm, we may:

• Display emergency hotline information
• Suggest professional resources
• Adjust AI responses to prioritize safety

However, SpeakOut cannot replace emergency services. In a crisis, please call your local emergency number immediately.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including but not limited to violation of these Terms. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the app or via email. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to conflict of law principles.
